As a client, you bear little direct liability. Broadly speaking, that is correct.<\/p>\r\n\r\n  <p class=\"cs-emphasis\">But that protects you against exactly one thing: a court judgment. It does not protect you from seeing your name in the newspaper, and since this year, it also provides considerably less protection against the bill.<\/p>\r\n\r\n  <p>Two things have changed in 2026 that you should know about. And there is one thing that has not changed, yet is still misunderstood by most organisations. Let us start with that, because it is the most important point.<\/p>\r\n\r\n  <div class=\"cs-section-title\">\r\n    <span class=\"cs-section-num\">1<\/span>\r\n    <h3 class=\"cs-section-heading\">The paradox of the A1 document<\/h3>\r\n  <\/div>\r\n  <p>In most situations, the A1 document is not a mandatory document. You cannot simply require it on the basis of the law.<\/p>\r\n  <p>At the same time, the A1 is the only official document proving that someone is legally employed under the social security system of another Member State. It proves that the employee is registered with the company named on the form and that this company complies with its social security obligations in the sending country. There is no alternative that provides the same evidence.<\/p>\r\n  <p>Its legal force is also exceptional. The Court of Justice has repeatedly confirmed that an A1 certificate is binding on the institutions and courts of the host country, and that it only loses that binding effect once it has been definitively withdrawn by the issuing country. A provisional withdrawal is not sufficient. Only in cases of established fraud, and only after the proper dialogue procedure has been followed, can a national court set it aside.<\/p>\r\n  <p class=\"cs-emphasis\">So, in most cases, you cannot require it, you cannot replace it, and if you have one, it is almost untouchable. That is the paradox on which your entire file rests.<\/p>\r\n  <p>One more detail that often goes wrong: an A1 application is not an A1 document. For employees with European nationality working for a company established within the European Economic Area, requesting one may be defensible. If the employee comes from outside the EEA, ask for an effectively issued A1, because an invalid posting of a third-country national creates a real risk of illegal employment. And remember that the statutory maximum posting period is twenty-four months.<\/p>\r\n  <div class=\"cs-callout\"><span class=\"cs-callout-label\">Remember this<\/span>Make sure you have the original A1 document in your possession before you pay the invoice. After that, you no longer have any leverage.<\/div>\r\n\r\n  <div class=\"cs-section-title\">\r\n    <span class=\"cs-section-num\">2<\/span>\r\n    <h3 class=\"cs-section-heading\">What the law does not require, your contract can<\/h3>\r\n  <\/div>\r\n  <p>This is where the solution lies, and it is simpler than most organisations think.<\/p>\r\n  <p>You are allowed to ask for more than the law strictly requires. But then it must be included in the agreement between you and your contractor. Not in an email attachment, not in a safety instruction, and not as an expectation. In the contract.<\/p>\r\n  <p>Two provisions deliver the most value here.<\/p>\r\n  <p><span class=\"cs-emphasis\">E\u00e9n.<\/span> State that every employee of the foreign company must hold a valid A1 document, and that you must receive that document before payment. If it is missing and you only receive an application or an acknowledgement of receipt, you impose the withholding obligation.<\/p>\r\n  <p><span class=\"cs-emphasis\">Twee.<\/span> Your own statutory withholding obligation extends to your first subcontractor. No further. Therefore, include a contractual provision requiring the main contractor to apply that obligation to its own subcontractors in turn. If you do not, your chain stops at the first link while your risk does not.<\/p>\r\n  <p>Neither provision costs you anything. They simply need to be written into the agreement before the cooperation begins, and that is precisely the moment when nobody thinks about them.<\/p>\r\n\r\n  <div class=\"cs-section-title\">\r\n    <span class=\"cs-section-num\">3<\/span>\r\n    <h3 class=\"cs-section-heading\">Two changes in 2026 that change your exposure<\/h3>\r\n  <\/div>\r\n  <p class=\"cs-emphasis\">Since 1 February 2026, criminal fines under social law have increased by one quarter.<\/p>\r\n  <p>The Act of 19 December 2025 increased the additional surcharges from eight to ten. A level four offence now carries a criminal fine of EUR 6,000 to EUR 70,000, or an administrative fine of EUR 3,000 to EUR 35,000. Level three carries a criminal fine of EUR 2,000 to EUR 20,000, or an administrative fine of EUR 1,000 to EUR 10,000. In aggravating circumstances, a mandatory minimum of half the maximum fine now applies.<\/p>\r\n  <p>An important detail for anyone working with posted workers: failure to submit a Limosa declaration is a level four offence, and the fine is multiplied by the number of workers involved. With a team of twenty, the amount can quickly add up. Level four offences can also carry potential prison sentences ranging from six months to three years.<\/p>\r\n  <p class=\"cs-emphasis\">From 1 May 2026, the withholding obligation will also apply to self-employed subcontractors.<\/p>\r\n  <p>For works involving immovable property in the construction and cleaning sectors, a new withholding of 15 percent of the invoice amount excluding VAT applies when the self-employed person has outstanding social security contributions exceeding EUR 2,647. The amount withheld is paid to the National Institute for the Social Security of the Self-Employed. Failure to apply the withholding can result in an administrative fine of up to 15 percent of the invoice amount, with a maximum of EUR 10,578.23 for 2026.<\/p>\r\n  <p>This new rule does not apply where a withholding obligation already exists for the National Social Security Office and the Federal Public Service Finance together. And the total withholding, social and tax combined, can never exceed 50 percent of the invoice amount.<\/p>\r\n  <div class=\"cs-callout\"><span class=\"cs-callout-label\">Why this matters<\/span>Self-employed subcontractors were largely outside this system until now. That was precisely where the gap was. From May onwards, that gap is closed, and the responsibility for checking lies with you.<\/div>\r\n\r\n  <div class=\"cs-section-title\">\r\n    <span class=\"cs-section-num\">4<\/span>\r\n    <h3 class=\"cs-section-heading\">The withholding obligation is not a one-off check<\/h3>\r\n  <\/div>\r\n  <p>This is the most common mistake I see in practice.<\/p>\r\n  <p>Organisations check the withholding obligation when entering into the agreement, tick the box, and move on. That moment is indeed important: if the contractor has social security debts at that point and you nevertheless enter into the agreement, you may be held jointly and severally liable for those debts.<\/p>\r\n  <p>But, in principle, the National Social Security Office does not invoke that joint and several liability when you correctly apply the withholding at every payment. This means checking the status again for every instalment on <a href=\"https:\/\/www.checkinhoudingsplicht.be\" target=\"_blank\" rel=\"noopener\">www.checkinhoudingsplicht.be<\/a>, and withholding and paying over 35 percent when there are social security debts. For tax debts, just as for debts owed to the National Institute for the Social Security of the Self-Employed, the rate is 15 percent.<\/p>\r\n  <p>For foreign subcontractors too, checking www.checkinhoudingsplicht.be is advisable because the system now also includes, for posted workers, PDOK debts relating to bad-weather compensation certificates. In addition, you must have a valid A1 certificate for every posted worker. If it is missing, the 35 percent withholding obligation still applies.<\/p>\r\n  <p>There is also an upside. Once you have made the withholding and transferred the funds, the National Social Security Office becomes the contractor&#8217;s point of contact. Not you. The contractor must then provide the necessary evidence itself, such as the missing A1 documents.<\/p>\r\n  <p class=\"cs-emphasis\">The withholding obligation is therefore not a punishment. It is the instrument that allows you, in a sense, to buy out your liability and put the problem back where it belongs.<\/p>\r\n\r\n  <div class=\"cs-section-title\">\r\n    <span class=\"cs-section-num\">5<\/span>\r\n    <h3 class=\"cs-section-heading\">The database you should not trust blindly<\/h3>\r\n  <\/div>\r\n  <p>There is something I need to say about Limosa that you may not expect from someone sitting on my side of the table.<\/p>\r\n  <p>The Limosa database is \u201ccontaminated\u201d. The same company often appears under multiple names. Complex first and last names are sometimes reversed, and so on. This is not a criticism of those managing the database. It is a consequence of declarations submitted through an open application by dozens of countries, administrations and companies.<\/p>\r\n  <p class=\"cs-emphasis\">The practical conclusion is this: do not connect that database to a system that autonomously decides whether someone is allowed onto the site that day. That is a decision you do not want to outsource to contaminated data.<\/p>\r\n  <p>There is another reason to be cautious. Your liability as a client concerns whether a Limosa declaration exists, not its detailed content. The foreign employer is responsible for the content. That may sound reassuring, until you realise that you still have to check that a declaration actually exists before the work begins.<\/p>\r\n  <p>Joint and several liability always applies within the direct relationship. You are responsible for the Limosa declarations of the main contractor you work with. That main contractor is, in turn, responsible for those of its subcontractors. Self-employed workers do not require a Limosa declaration, except in certain high-risk sectors.<\/p>\r\n\r\n  <div class=\"cs-section-title\">\r\n    <span class=\"cs-section-num\">6<\/span>\r\n    <h3 class=\"cs-section-heading\">Why this carries more weight now than five years ago<\/h3>\r\n  <\/div>\r\n  <p>It is not only the stricter rules that are increasing the impact. The growing volume is also a factor.<\/p>\r\n  <p>In the second quarter of 2024, the Belgian construction sector counted 37,860 posted workers. That represents approximately nineteen percent of the sector&#8217;s workforce. The five main countries of origin were Romania, Portugal, Ukraine, the Netherlands and Poland, with between 4,800 and 5,600 workers each. At the same time, according to the sector federations, there were at least 14,000 vacancies.<\/p>\r\n  <p>In other words, posting is no longer a marginal phenomenon. It has become a way of addressing a structural labour shortage. Almost one in five people on a Belgian construction site works under a foreign social security system, with documents in a language and format that your own administration does not deal with every day.<\/p>\r\n  <p>Chain monitoring through meticulous attendance registration is a key element of Minister Rob Beenders&#8217; social fraud policy. Following the example of the cleaning sector, he is currently rolling out Check-In-And-Out across the construction sector, replacing the previous Check-In-only system. This will allow all parties involved, each within their own responsibilities and liabilities, to have a real-time view of who is present on the site and in what capacity. Increasingly advanced digital attendance registration is extremely important for safety and should help prevent a recurrence of recent tragedies and scandals.<\/p>\r\n  <div class=\"cs-callout\"><span class=\"cs-callout-label\">The key point<\/span>Your exposure is increasing as a result of the labour shortage, the shift towards more posted workers and the increasing digitalisation of government and inspection services. That is precisely why a system that was sufficient five years ago is no longer sufficient today.<\/div>\r\n\r\n  <div class=\"cs-section-title\">\r\n    <span class=\"cs-section-num\">7<\/span>\r\n    <h3 class=\"cs-section-heading\">Seven things you can do this month<\/h3>\r\n  <\/div>\r\n  <p><span class=\"cs-emphasis\">1.<\/span> Take one current contract with a foreign contractor and look for the provision concerning the A1 document. If it is not there, you know what your next contract template needs.<\/p>\r\n  <p><span class=\"cs-emphasis\">2.<\/span> Require the original A1 to be in your possession before payment at the latest. Before work begins, at minimum, an acknowledgement of receipt of the application should be available.<\/p>\r\n  <p><span class=\"cs-emphasis\">3.<\/span> Add a provision requiring the main contractor to apply the withholding obligation to its own subcontractors.<\/p>\r\n  <p><span class=\"cs-emphasis\">4.<\/span> Check whether your payment process verifies the withholding obligation for every instalment, rather than only when the contract is signed.<\/p>\r\n  <p><span class=\"cs-emphasis\">5.<\/span> Find out whether your organisation is already taking the extension to self-employed workers from 1 May 2026 into account. For many companies, this is a new category within an existing process.<\/p>\r\n  <p><span class=\"cs-emphasis\">6.<\/span> Verify that a Limosa declaration exists before work begins. The content is not your responsibility, but the existence of the declaration is. Missing Limosa declarations must be reported through the Limosa application.<\/p>\r\n  <p><span class=\"cs-emphasis\">7.<\/span> Actively ask your domestic and foreign contractors about their policy on legal employment. Not necessarily because the law requires it, but because their answer tells you something.<\/p>\r\n\r\n  <h3 class=\"cs-closing-heading\">Finally<\/h3>\r\n  <p>Work according to the principle of due diligence. Under the Flemish regional regulations on chain liability for illegal employment, this is even a legal concept. You can simply tick the box somewhere, but it is also a healthy basic attitude in other areas: you can demonstrate that you have checked what you could reasonably be expected to check.<\/p>\r\n  <p class=\"cs-emphasis\">Because in court, the focus will be on your liability. Outside the courtroom, the focus will be on your name, and the threshold there is considerably lower.<\/p>\r\n  <p class=\"cs-disclaimer\">This contribution contains general information and does not constitute individual legal advice.
