Welke bedrijven moeten nagaan of hun (onder)aannemers sociale of fiscale schulden hebben? Elke onderneming die werkt met\u00a0(onder)aannemers uit de bouwsector, de vleesverwerkende sector, bewakingsfirma\u2019s, onderhoudsfirma&#8217;s of reinigingsfirma&#8217;s.<\/h5>\n<p>\n<\/p>\n<p><br \/>\n\n\n<p>\n<strong>Wat is inhoudingsplicht?<\/strong><br \/>\nBent u een opdrachtgever die werken door een aannemer laat uitvoeren? Of een aannemer die werken door een onderaannemer laat uitvoeren? Dan moet u VOOR het betalen van de factuur nagaan of uw medecontractant fiscale of sociale schulden heeft. Heeft deze een openstaande schuld dan bent u verplicht een deel van de te betalen factuur door te storten aan de fiscus of de RSZ.<br \/>\nBij sociale schulden gaat dit om 35% van het factuurbedrag excl. btw. Bij fiscale schulden moet u\u00a015% van het bedrag van de factuur (excl. btw) inhouden en doorstorten.<\/p>\n<p><strong>Sanctie<\/strong><br \/>\nIndien na betaling van een factuur blijkt dat er toch fiscale en sociale schulden zijn, dan wordt u hoofdelijk aansprakelijk gesteld voor deze schulden. U moet dus een tweede keer betalen. Voor sociale schulden bent u aansprakelijk voor de totaalprijs van de werken (exclusief btw).<br \/>\nVoor de fiscale schulden gaat dit om 35% van de totaalprijs.<\/p>\n<p><strong>Tijdrovend en arbeidsintensief<\/strong><br \/>\nHet naleven van de inhoudingsplicht is een tijdrovend karwei.
